Section 1 Scope of application

These General Terms and Conditions (T&Cs) apply exclusively to participation in events organised and offered by TVB Kufsteinerland, Unterer Stadtplatz 11-13, 6330 Kufstein (hereinafter referred to as the “Organiser”). Any deviating or conflicting terms and conditions of the participant shall not form part of the contract, even if they are not expressly objected to by the Organiser, unless there is express written consent from the Organiser regarding validity of the participant’s terms and conditions. The following T&Cs apply to the entire period of the contractual relationship between the Organiser and the participant, as well as for all services associated with the booking of and participation in the event arranged by the Organiser.

Section 2 Conclusion of contract

The contract regarding participation applies for the duration of the event for which a ticket is purchased, and is concluded with transmission of an electronic booking via the booking form and associated acceptance. The Organiser must accept the booking in written form. A booking is binding; the purchase will be confirmed with an email from the Organizer. If the booking is made by a private person then attendance at the event is a leisure activity, which means that special rights of withdrawal in accordance with the Distance and Outbound Business Law do not apply.

Section 3 Payment, cancellation and transfer to third parties

The prices listed on the website are gross prices in euros. The final price is due, without deductions, within the payment term noted on the invoice. The Organizer reserves the right to refuse the participant entry to the event if an invoice is not paid. The participant’s entitlement to a ticket lapses upon non-payment. In accordance with Point 2, cancellation is not possible. Transferral of tickets in the form of a prize draw / competition, either analogue or digital, is prohibited. The Organizer reserves the right to refuse entry to the festival for participants who are in possession of unapproved competition tickets.

Section 4 Right to withdrawSection 4 Right to withdraw

You have the right to withdraw from this contract without statement of reasons. The withdrawal period is ten days from the day that the contract is concluded. In order to exercise your right to withdraw, you must send a clear written statement to Tourismusverband Kufsteinerland, Unterer Stadtplatz 11-13, 6330 Kufstein or info@kufstein.com (e.g. with a letter, email or our contact form) informing us of your decision to withdraw from this contract. To comply with the withdrawal period it is sufficient to send the statement regarding exercise of the withdrawal right before expiry of the period.

4.1 Consequences of withdrawal
If you withdraw from this contract, we must refund to you all payments that we have already received from you, including the postage fees (with exception of any additional costs that resulted from your selection of a different delivery method than the cheapest standard delivery that we offer) promptly, and at the latest within fourteen days from the day on which we received the statement of your withdrawal from this contract. For this repayment we will use the same method of payment as used in the original transaction. The repayment will in no case be made in cash. If you requested that the service begun within the withdrawal period, then you must pay us an appropriate amount that represents the proportion of the services already rendered, compared to the total services provided for in the contract, at the time that you informed us of your decision to withdraw from the contract

4.2 Exclusion of the right of withdrawal
A right to withdrawal does not exist if, with conclusion of the transaction, you are exercising your commercial or independent professional interest, and should therefore be seen as an entrepreneur. In this type of contract, the right to withdrawal against TVB Kufsteinerland does not apply, as the contract is not concluded between you and TVB Kufsteinerland but rather between you and a third party. In this case, any rights of withdrawal can only be claimed against the third party. Note: You expressly agree that performance of the services will start before the withdrawal period ends.

Section 5 Accuracy of data

The participant shall ensure that the data provided are true and complete. The user is obliged to ensure that the data remain true and complete for the entire contractual period, and for all applications used by them.

Section 6 Legal age

The participant guarantees that they are of legal age (over the age of 18). If, as part of certain applications, the participant represents a legal person, then the participant guarantees that they are authorised to act on behalf of this legal person. Upon request, the participant will provide evidence to TVB Kufsteinerland regarding statements outlined in these provisions.

Section 7 Ticket handling

The ticket for the respective areas (event areas) should be kept, and can no longer be transferred after validation. Commercial resale of the tickets is not permitted. The tickets may not be sold privately at a higher price than that printed on the ticket plus documented fees that were calculated upon purchase of the ticket. As already stated, usage of the tickets for prize draws and/or competitions is expressly prohibited. Breach of these conditions shall lead to loss of access authorisation to the event without compensation, i.e. the ticket loses its validity and the Organizer is authorised to confiscate the entry ticket without reimbursing any costs. If a ticket is lost it will not be replaced.

Section 8 Services

All speakers / course instructors provide their own services. The scope, form, topic and aim of the services are outlined in the programme booklet and on the homepage, and are known to the participant. The right is reserved to make changes to the programme content and the speakers / course instructors due to force majeure, illness, accident or other factors, or for circumstances that are beyond the control of speakers / course instructors. A change to the programme has no effect on the cancellation policy.

Section 9 Hotel reservations for participants

The general terms and conditions of the Kufsteinerland Tourist Board as a package tour operator apply to hotel reservations.

Section 10 Photos and video recordings

The Organizer is permitted to, and will, take photos and video recordings for later usage in advertising and for uploading to social networks. With transmission of their registration/booking, the participant agrees that they can be photographed or filmed as part of these activities, and that the Organizer retains all rights to the resulting photographs and video recordings.

The following data protection regulations apply

Participants are permitted to take photographs and video recordings for private and non-commercial purposes.

Section 11 Behaviour during the event

Participants are not permitted to carry out unusual, active advertising for themselves or third parties. Specific unusual activities include all forms of advertising that the Organizer allows its partners to carry out in return for payment, such as the setup of an exhibition stand, distribution of brochures/flyers, provision of sample products or the pouring of beverages. If this provision is violated, then the Organizer is entitled to exclude the participant from the event. In this case, the participant is not entitled to any reimbursement of costs. Claims for damage by the Organizer remain unaffected. If the participant behaves improperly, illegally or in a way that is harmful to the Organizer, then the Organizer is likewise entitled to exclude the participant from the event. In this case, the participant is also not entitled to any reimbursement of costs. The Organizer reserves the right to assert additional damage claims.

Section 12 Copyright

Otherwise unauthorized reproduction, processing or utilization of data released by the Organizer is only permitted with written agreement of the Organizer. Any other processing, reproduction, distribution or public display is a violation of copyright.

Section 13 Weather

The Organizer reserves the right to interrupt or cancel outdoor events at any time if there is a weather-related danger to the visitors, or it is raining. The participant is not entitled to any reimbursement of costs.

Section 14 Contact

To ensure smooth processing, the Organizer reserves the right to send the participant preliminary information regarding the festival organisation.

Section 15 Cancellation of the event

The organizer reserves the right to cancel the event.

Section 16 Liability

Participation in the event is at your own risk. The Organizer accepts no liability for personal injury or property damages. The court of jurisdiction is Kufstein.
